
Court quashes FIR against an accused noting government communication in this regard

NEW DELHI — The Tamil Nadu government has told the Madras High Court that it has decided to withdraw all cases filed against protestors during the anti-CAA movement.
The single bench of Justice N Anand Venkatesh noted the “policy decision (of Tamil Nadu Govt) that all the cases that were registered against those who indulged in protest against the Citizenship Amendment Act are going to be withdrawn by the State”.
It was mentioned in an order that quashed the criminal proceedings in the lower court against advocate S Devika who was facing a police FIR for protesting against the controversial citizenship law.
The order was passed on March 1 but this was first reported by legal website Live Law on Tuesday.
The High court while quashing the proceedings in lower court said that the police cannot register FIR under Section 188 IPC.
