RANCHI – After Jharkhand police dropped murder charges in Tabrez Anzari mob lynching case, his family and counsel on Tuesday alleged that the police are trying to protect those involved in his killing by weakening the case.
In the FIR filed in the case, the police had invoked murder charges against 11 accused under IPC section 302 on a complaint by Tabrez’s Wife. But while filing the chargesheet, they changed the murder charge into culpable homicide (304) not amounting to murder citing postmortem report on Tabrez’s death.
The police claimed that the latest postmortem report shows that he died of cardiac arrest.
Reacting to this change in charges, Tabrez’s uncle Moulana Masroor said, “I’m of the opinion that the administration is doing so to protect the culprits. There is nothing else. Otherwise, Section 302 should have been invoked instead of Section 304 which is invoked in minor cases. Here, he has been murdered in cold blood.”
Altaf Hussain, counsel for Tabrez’s family in the case, also alleged that the police are protecting the culprits, the police officer and the doctor are involved in the case. He said he had filed a protest petition in the court against removal of the murder charge.
The police were quoting doctor to justify their action, but he said the doctor himself is a culprit. A case of murder should also be lodged against the doctor who has declared an unfit person as fit. Section 302 is being removed to “protect the doctor too”.
Refuting the police claim, Masroor further said, “Blood was oozing from Tabrez’s mouth when he was being thrashed by the mob. His chest was hit by a heavy stick leading to heart attack and he succumbed soon after.”
“The cardiac arrest was the result of the beating he received,” he concluded adding how else could such a young man suffer from cardiac arrest?”
On June 18, 22-year-old Tabrez Ansari was brutally beaten up by a mob tying him to a pole in Jharkhand’s Datkidih village. They also forced him to chant ‘Jai Shri Ram’ and ‘Jai Hanuman’.
After the incident, the police arrested Tabrez and sent him to judicial custody. After spending four days in jail, Tabrez was shifted to a hospital where he succumbed to his injuries. Question is being raised as to why the police did not rush him to the hospital soon after rescuing him from the mob even though he was severely injured with blood oozing from his head and mouth.
The case drew national attention after the gruesome video of his thrashing went viral on social media which subsequently evoked outrage across the country forcing Prime Minister Narendra Modi to break his silence on the lynching incidents. Tabrez’s case was raised even at a UN meeting.
Commenting on the incident, Kashif Raza Siddiqui, a political activist who met the family members of Tabrez, said that the way the law enforcement agency is standing by the culprits is a threat to democracy. This will weaken the faith of people in the judiciary. It seems they have prejudices against a particular community. He said if the administration fails to secure less than death penalty for the culprits, his party Bahujan Kranti Morcha will take to the street.
When the Caravan Daily took up with the investigating officer in the case, Raj Narayan Singh, the allegation that the police are trying to protect the culprits, he declined to comment.
