NEW DELHI — Former president of Latur Bar Association and Judge Brijgopal Harkishan Loya’s old friend Uday Gaware, while speaking at a public meeting here on Monday, said that his friend Judge Loya’s death was a premeditated murder and it must be probed.

“If the worshippers of the pen sleep, then worshippers of the nation will sell off the country. Loya was my friend. Both of us finished our law degrees together. All his judgments were impartial. He came from a very ordinary family. He embraced death but never sold his integrity,” said Advocate Gaware speaking at the seminar organised by All India People’s Forum.

Judge Loya, who was hearing the Sohrabuddin Shaikh fake encounter case in a CBI court in Mumbai, died in mysterious circumstance on December 1, 2014 in Nagpur. Official records said he died of heart attack. However, his family members raised various questions surrounding his death and their concerns were published in two investigative reports by The Caravan Magazine in November 2017. BJP chief Amit Shah and some IPS officers of Gujarat were accused in the case. Shah and all IPS officers were later acquitted by the CBI court.

“The day Loya died, the same day, people, including many judges, started telling me that Loya has been cheated. The matter was so sensitive that no one dared to file a complaint. Now I feel, we should not have been so fearful. Loya’s death was a premeditated murder,” Advocate Gaware was quoted as saying by The Wire.

Besides Gaware, The Caravan Magazine’s journalist Niranjan Takle who broke the story, the magazine’s political editor Hartosh Singh Bal, former judge of the Bombay high court BG Kolse Patil and former Additional Solicitor General Indira Jaising also addressed the gathering. All demanded a high-level probe into Judge Loya’s death.

On Friday (Jan 12) noon, four senior-most judges of the Supreme Court went public in an unprecedented move to say that high profile cases were being assigned to benches at the apex court without any rationale.

On the same day, a petition seeking independent probe into Judge Loya’s case was given to a bench of a junior judge. While the four judges had been raising the issue of allocation of important cases for the past two months, Judge Loya’s case proved to be a flash point and they went public.

Interestingly, two days later Loya’s son Anuj Loya accompanied with a lawyer and a former judge addressed a press conference in Mumbai to say that he had no doubt that his father died of heart attack and his family should no more be harassed.

However, the Supreme Court has begun hearing in the case. In today’s hearing, the top court asked Maharashtra government’s counsel to provide all documents related to Judge Loya’s death to the petitioners and adjourned the hearing for one week without fixing any date.
