Calcutta HC Division Bench Quashes Order Allowing BJP’s ‘Rath Yatra’ Rallies

KOLKATA — The BJP’s plans to take out “Rath Yatra” rallies, christened “Save Democracy Rallies”, in West Bengal again hit a roadblock, with a Calcutta High Court Division bench on Friday quashing the order of a single bench that gave conditional go-ahead to the programme.

The Division Bench comprising Chief Justice Debasish Kargupta and Justice Shampa Sarkar sent the case back to the single bench with a directive that the latter consider the intelligence inputs provided by the state agencies, reports IANS.

The quashing the order of a single bench that gave conditional go-ahead to the programm on Thursday is a major set back for the BJP party as they were rejoicing and distributing sweets among the cadres of the party for their ‘temporary win’ against West Bengal Chief Minister Mamata Banerjee.

The BJP had moved a single bench of the Calcutta High Court on December 17 after the Bengal government’s decision not to allow rallies and proposed December 22, 24 and 26 as fresh dates for the three Rath Yatra rallies.

Justice Tapobrata Chakraborty on Thursday had allowed the rallies to be taken out, but said the organisers have to inform the police superintendent of the district concerned 12 hours before taking out the yatra.

The state’s Mamata Banerjee government had moved an appeal at the division bench against the single bench order and sought urgent hearing.
