One More Night in Jail for​ Aryan Khan as Bombay HC Adjourns Bail Hearing Till Thursday

MUMBAI — The Bombay High Court on Wednesday adjourned till Thursday afternoon the ongoing hearing in the bail plea of Aryan Khan, son of Bollywood megastar Shahrukh Khan, and others, whose arguments were completed.

Arguing strongly for bail, Aryan Khan’s lawyers on Wednesday termed his arrest was “illegal” and invoked his constitutional rights, reports IANS.

Today (Wednesday) was the second day of hearing on bail pleas filed by Aryan and two others in Bombay High Court.

Lawyers of Aryan Khan, Munmun Dhamecha and Arbaz Merchant concluded arguments on their bail applications.

Additional Solicitor General Anil Singh, appearing for the Narcotics Control Bureau (NCB), will respond to the defence arguments at 3 p.m. on Thursday.

“The arrest memo did not give the true and correct grounds for arrest – Article 22 of the Constitution is more important than Section 50 of the CrPC. It states that no person should be held without being informed about the grounds of arrest and the person shall have the right to consult a lawyer of their choice,” argued Former Attorney-General of India Mukul Rohtagi appearing for Aryan Khan.

He contended that the courts were misled by the NCB to believe that large quantities of drugs were recovered from the accused and said that the agency had proceeded in sheer violation of Article 22, reports IANS.

Pointing out that while “bail is the rule and jail is the exception”, senior counsel Amit Desai argued that now it has become “arrest is the rule and bail is the exception” for the police.

Rohtagi requested the Bombay High Court to go through the arrest memo again. He pointed out that at the time of Aryan Khan’s arrest there were no charges of conspiracy.

As the bail plea is adjouned, Aryan Khan, Arbaaz Merchant, and Munmun Dhamecha will spend another night in judicial custody.
