Delhi Riots: Citing Godhra Ruling, Court Orders Separate Trials of Hindu, Muslim Accused

NEW DELHI — A Delhi court used the reference of Godhra riots while ordering the separation of trial of accused persons on the basis of their religion in connection with a case related to Delhi riots.

While dealing with an FIR that names five men including three Hindus and two Muslims accused by rioting and murder of one Salman, Additional Sessions Judge Vinod Yadav, according to Live Law, said that starting the trail together for accused from different religions purportedly acting under two different conspiracies and unlawful assemblies is definitely going to prejudice the defence of the accused.

The court relied on the Godhra trail where the trail had been separated by the High Court on the basis of religion of the accused as the judge observed: “This court also deems it appropriate to separate the trial of the accused persons so that their defence may not even likely get prejudiced.”

The court asked the police to furnish a complete set of chargesheet in physical form within two weeks.

“The existing chargesheet shall be treated as chargesheet for three accused persons namely, Kuldeep, Deepak Thakur and Deepak Yadav, whereas the other charge sheet shall be treated as chargesheet for accused persons Mohd. Furkan and Mohd. Irshad,” Live Law cited the judge saying.

The charges against the accused persons have been framed under Sections 147, 148,149, 153-A, 302, 436, 505, 120-B and 34 of IPC.
