A three-judge Supreme Court bench ruled that Hussain could be released for 12 hours each day from January 29 to February 3 to campaign in his Mustafabad constituency

NEW DELHI – The Supreme Court on Tuesday approved a six-day custody parole for former Aam Aadmi Party (AAP) councillor and 2020 Delhi riots accused Tahir Hussain, allowing him to campaign for the February 5 Delhi Assembly elections.
A three-judge bench led by Justice Vikram Nath ruled that Hussain could be released for 12 hours each day from January 29 to February 3 to canvass in the Mustafabad constituency from where he is contesting as an AIMIM candidate.
Under police supervision, Hussain will be permitted to leave Tihar Jail during the day but must return at night. The court also directed him to deposit ₹2.47 lakh in advance to cover security costs for the first two days, with subsequent payments to be made in two installments for the remaining four days.
The order comes as Hussain awaits a decision on his bail plea before the Delhi High Court. Earlier, on January 22, a two-judge bench comprising Justice Pankaj Mithal and Justice Ahsanuddin Amanullah delivered a split verdict on his interim bail request.
Justice Mithal rejected Hussain’s plea, while Justice Amanullah ruled that he should be granted interim bail.
The AIMIM candidate requested the top court to be allowed to campaign. Senior advocate Siddharth Aggarwal, appearing for Hussain, told a bench of Justices Nath, Sanjay Karol and Sandeep Mehta that only four to days are left for campaigning so he is allowed to connect with the electorate under police custody.
