Court Frames Charges Against 7 Accused for Killing Muslim Man During Delhi Riots

NEW DELHI — A Delhi Court has framed charges of murder, rioting and other offences against seven persons for killing a Muslim man during Delhi riots of February 2020.

The man had died after allegedly being beaten by a mob. Additional Sessions Judge Vinod Yadav framed charges against Aman Kashyap, Arun Kumar, Ashish, Devender Kumar, Pradeep Rai, Krishan Kant Dhiman and Rahul Bhardwaj after observing that there was prima facie enough material on record to frame charges against them, reports Live Law.

The charges have been framed under Sections 143 (unlawful assembly), 147 (rioting), 148 (rioting, armed with deadly weapon), 302 (murder) of the Indian Penal Code read with Sections 149 (offence committed by any member of unlawful assembly in prosecution of common object) and 120B (criminal conspiracy) of the IPC.

However, the Court observed that the Prosecution could not establish material with regards to sec. 188, 427 and 436 of IPC as well as sec. 3 and 4 Prevention of Damage to Public Property Act.

An FIR was registered on 1st March last year wherein one Monish, who got admitted in the hospital by unknown persons, was declared as brought dead.

It was the prosecution’s case that during the course of investigation, an eye witness namely Manoj Kaniyal had identified Monish from the footage of CCTV camera installed at GTB Hospital, who also disclosed that Monish was carrying sweets with him at the time of incident.

According to the Prosecution, the eye witness had also stated that Monish was beaten by a mob with laathi/danda/talwar which also started pelted stones, as soon as they came to know that he belonged to Muslim community.

The accused persons had refuted the charges on the ground that they were falsely implicated in the matter and that there was an unexplained delay of 5 days in registeration of FIR.

“In view of the aforesaid discussion, I am of the considered opinion that prima facie there is enough material on record to frame charges against all the accused persons under requisite sections,” the court said.
