Karnataka Proposes Prison Term and Fine for Fake News, Misinformation

A six-member social media regulatory authority would be set up to ban the promotion and spread of fake news

BENGALURU — The Congress government in Karnataka has proposed a new bill to combat fake news and misinformation, which includes severe penalties for those found guilty. The Karnataka Misinformation and Fake News (Prohibition) Bill 2025 aims to regulate social media and prevent the spread of false information.

Accordingly, the government proposes to constitute a six-member social-media regulatory authority to ban promotion and spread of fake news on social media, prohibit posting of content insulting to women, ban publication of content that disrespects Sanatana Dharma, its symbols, beliefs and content which promotes superstition, media reports said on Sunday.

The key provisions of the Bill envisage up to 7 years in prison or a fine of Rs 10 lakh, or both, for sharing unverified information on social media. It also seeks two to five years in jail and a fine for misinformation on social media or in publications. The bill proposes the establishment of special courts to handle cases related to fake news and misinformation. These courts will have the power to issue directions to intermediaries, publishers, and broadcasters to remove content deemed to be fake or misleading.

Failure to comply with court directives can result in simple imprisonment of up to 2 years and a fine of Rs 25,000 per day, subject to a maximum of Rs 25 lakh. The bill also proposes action against directors of companies and employees if their company is found guilty of violating the law.

It suggests special public prosecutors for every special court for fake news and misinformation, besides proposing punitive action under the Bharatiya Nyaya Sanhita against those posting fake news.

The proposed bill aims to prevent the spread of fake news and misinformation, which can have serious consequences for individuals and society. By regulating social media and holding those responsible accountable, the government hopes to create a safer and more informed online environment.
