Prof Mahmudabad’s Arrest is a Blatant Violation of Fundamental Rights: Jamiat

NEW DELHI — Calling the arrest of Ashoka University faculty Prof Ali Khan Mahmudabad a blatant violation of fundamental constitutional rights, particularly the right to freedom of expression, the Jamiat Ulama-i-Hind (Mahmood faction) urged that the matter be reviewed under the true spirit of justice and democratic values.

In a statement on Monday, Jamiat president Maulana Mahmood Madani expressed serious concerns over the recurrence of such biased and prejudiced government action.  

Referring to the statement attributed to Prof Mahmudabad, he said, “From what I have learnt, his remarks do not in any way amount to sedition or contempt of the nation. In a democracy, the right to critique government policies or express dissent is not only protected but essential.

Maulana Madani also condemned the apparent double standards in the government’s response to public discourse. “A minister from Madhya Pradesh publicly refers to someone as the ‘sister of terrorists’ — a deeply divisive and irresponsible statement — yet no action is taken by the government or the ruling party despite the court’s rebuke. This selective application of the law undermines public confidence in institutions tasked with upholding justice,” he said.

He emphasised that institutions meant to safeguard democracy must understand that the law is intended to protect, not suppress, the freedom of citizens. “A democratic society thrives not through fear and enforced silence but through respect for diverse opinions and open dialogue,” he said.

Maulana Madani called upon the government to immediately intervene and ensure the unconditional release of Prof Mahmudabad. It is imperative that justice is not only done but is also seen to be done,” he concluded.
