NEW DELHI – Family of 27-year-old Adam Khan, who was attempted to be lynched by a mob in Maharashtra’s Nalasopara, accused the local police of going soft towards the arrested accused by not adding relevant IPC sections against them.

On Sunday, a video of Adam being hit hard by some people with some object even as he is severely injured and is pleading for life. On-lookers can be seen inciting the lynch mob to hit him harder. He was rescued by some women who intervened and could be able to stop the assaulters. He is now fighting for life in a hospital.

The local police have arrested five of the accused assailants after the incident. But what’s intriguing is that they also registered an FIR against Adam, on a charge of theft. The police claimed that the victim was caught when he was trying to seal something. The incident happened on 25 November.

However, talking to Clarion India, family members of the victim said that the allegation of theft is fabricated as there was no evidence to prove it.

“Give an evidence of theft. There are shops which have CCTV cameras. Tell me what he has stolen,” said Sher Mohammed Khan, father of Adam.

According to Sher, his son was assaulted when he was returning from a religious tour of Tablighi Jamaat in Mumbra. On the way, he had an altercation with one, Dubey Jelibwala, who is allegedly associated with Bajrang Dal. Dubey Jelibwala, along with others, caught hold of him, shouted ‘thief thief’ and started thrashing him. They also robbed his money and mobile.

He accused the police of ignoring his complaint with regard to the case. “The police booked the accused under IPC 326 sections on their own. We are demanding to book them under 307 (attempt to murder)..we visited the police state two times but they are not hearing our complaint”.

Talking to Indian Express, Sub-inspector Anil Maske said, “Five people were arrested for brutally assaulting Adam. We also registered an FIR of attempted theft against Adam in which the owner of Jai Bhavani Jewellers is the complainant”.

Waseema Khan, mother of Adam, is angry with the police for going soft towards the accused. She said she has no hope of justice from the police as they are not booking the accused under the relevant section.

In her complaint letter written to the senior police inspector at Pelghar police station, Waseema asked the local police to transfer the case to the crime branch and add section 307 in the FIR.

“Looking into the seriousness of the matter and the assailants being powerful Local political goons, there are attempts to hamper/temper the prosecution evidence therefore, the said matter be transferred to the State Local Crime Branch for an impartial and effective investigation, in the interest of justice,” reads the complaint letter.

The complaint was also sent to the chief minister’s office, chief justice of Bombay High Court, Chairman of Maharashtra State Human Rights Commission, State Minorities Commission and others.

In the complaints, Waseema said “That on 4/12/2022 upon enquiry with some of the local NGO workers, I and family have learnt that we are being misguided by the officers of your police and I was shocked to hear that despite of such merciless attack on my son with an intention to cause his death and despite of Video evidence available with the officers of your Police Station still section 307 of the I.P.C has not been added to the said F.I.R”.
