It’s Partial Relief, Says Dr. Kafeel After Allahabad HC Stays Second Suspension

Justice Saral Srivastava directs the authorities to conclude inquiry against him within one month

NEW DELHI – Doctor Kafeel Khan has said that Allahabad High Court’s stay on the second suspension order of Uttar Pradesh government against him is a partial relief. He would get full relief only when his job at Gorakhpur medical college is given back to him by the government.

Talking to Clarion India about Court’s stay on his suspension, Khan said: “I’m happy and the whole family is happy. I thank everyone who prayed for me in this struggle for the past four years. This is a partial relief…I’m hoping that I will join my job and serve the children”.

Khan, under suspension over the death of children at Gorakhpur BRD College in 2017, was suspended for a second time by the Yogi Adityanath government in July of 2019 alleging that he had forcibly treated patients at Bahraich District Hospital and criticized the policies of the government.

While hearing a petition filed by Khan against the second suspension, Justice Saral Srivastava, directed the authorities to conclude inquiry against him within one month and fixed the date of next hearing on 11 November.

The Court also asked the petitioner to cooperate in the inquiry and in case he does not, the disciplinary authorities may proceed the inquiry ex-parte.

The Court also asked the state government to file a reply in four weeks.

Khan had filed a petition against the suspension arguing that there is no purpose of second suspension order against an already suspended employees and there is no such rule which permits the government to pass such an order. He also argued that more than two years have passed since the suspension order was issued in July 2019 but the probe has not been completed.

Talking about the charges levelled against him in the second suspension, Khan said that it was related to the incident when he along with medical experts visited Bahraich to know the causes of death of children in September 2018.

“In August 2018, 78 kids died. The government called the cause of death as ‘mysterious fever’…We along with a team of experts and doctors went to find out the real cause behind illness as there is no such thing as mysterious fever or disease,” he said.

He was suspended a year after the visit. Khan asked as to why the government took one year to suspend him after the visit. The government took one year to suspend him because he had been given a clean cheat by BRD College in the 2017 children death tragedy in April this year, he said.

After the suspension, Khan said that he wrote more than 50 letters to revoke his suspension but the authorities did not pay attention to that. Then, he challenged both the suspension orders in the Allahabad High Court in two separate petitions. Earlier this month, the high court stayed the first suspension order.

Before that, the high court had also quashed the National Security Act (NSA) invoked against Khan by the state government for delivering a speech in Aligarh against the Citizenship Amendment Act (CAA).

Khan hopes that his job will be given back after the high court stayed the second suspension order against him. But he also fears that the government may also try to drag the case without reinstating him till the BJP will remain in power in this tenure. But he says he has firm belief in the judiciary.

He said though he is eager to get back his job at the BRD medical college, he also wants the real culprits responsible for the death of children in 2017, to be brought to justice. Those who lost their children should also be compensated.
