DU Student Files Plea in High Court Over Exams Scheduled on Eid Al-Adha

SIO and AISA demand transparency and rescheduling of the exam

NEW DELHI — A Delhi University law student has approached the Delhi High Court contesting the university’s decision to hold examinations on May 28, 2026 — the date designated as the Eid Al-Adha holiday by the Union government.

The petition contends that conducting exams on the holiday infringes upon the religious rights of Muslim students guaranteed under Articles 14, 21, 25, and 29 of the Constitution. It notes that key institutions, including the Supreme Court of India, have shifted their holiday calendar to May 28 in line with the government’s declaration. “Despite officially declaring 28.05.2026 a holiday, the Respondent University has arbitrarily decided to continue examinations on the said date,” the plea states.

The legal challenge follows protests from student groups who argue the move forces Muslim students to choose between observing Eid and appearing for exams. In a letter to the Vice-Chancellor, Registrar, and Controller of Examinations, Ahmed Rabeeh PR, chief of Fraternity Movement Delhi University, said the administration’s decision puts Muslim students in an “untenable position” despite “clear, prior warning.”

While DU later issued a circular recognising May 28 as an Eid holiday, it maintained that exams scheduled for that day would proceed unchanged.

The Students Islamic Organisation’s (SIO) DU unit called the decision “contradictory,” saying it “disregards the religious observance, accessibility, and concerns of thousands of students.”

The All India Students’ Association (AISA) has demanded an immediate rescheduling of the exams and greater transparency from DU authorities, urging the university to uphold “secular, inclusive values.”
