Assam Govt Repeals Muslim Marriage and Divorce Registration Act

NEW DELHI – As part of its first step towards Uniform Civil Code (UCC) in the state, the  Himanta Biswa Sarma government on Thursday repealed the Assam Muslim Marriage and Divorce Registration Act, 1935.

A government statement said the state Cabinet has accorded approval to the Assam Repealing Bill, 2024 which aims to repeal the Assam Muslim Marriages and Divorces Registration Act, 1935 and Assam Muslim Marriages and Divorces Registration Rules, 1935. This was essential, it said, to bring parity in the registration of marriage and divorce.

The Bill will be tabled in the next monsoon session of the state assembly for consideration.

If implemented Assam will become the second state after Uttarakhand to show green light to the UCC.

The Uttarakhand UCC Bill has also kept the tribal population out of its ambit. The BJP government in Gujarat has also brought a UCC Bill and plans to pass it in the state assembly soon.

“We have taken a significant step to ensure justice for our daughters and sisters by putting additional safeguards against child marriage. In the meeting of the #AssamCabinet today we have decided to repeal the Assam Muslim Marriages and Divorce Registration Act and Rules 1935 vide the Assam Repealing Bill 2024,” tweeted Chief Minister Sarma.
