NEW DELHI — A Delhi court has granted interim bail to former JNU student leader and social activist Umar Khalid for a week as he had sought the interim bail to attend his sister’s marriage.
Additional Sessions Judge Amitabh Rawat said Khalid will be granted interim relief from December 23 to December 30 after which he has been asked to surrender before the court without seeking any extension, Indian Express reports.
This is the first time Khalid will leave Tihar Jail ever since his arrest over two years ago in a UAPA case connected with the north-east Delhi riots.
Senior Advocate Trideep Pais represented Umar Khalid whereas Special Public Prosecutor Amit Prasad appeared for Delhi Police.
While seeking interim bail in the present case, Khalid’s lawyer had told the court that he will not talk to the media or meet the public if allowed to attend the wedding, according to Bar and Bench.
Opposing Khalid’s application, Delhi Police had claimed that he is “likely to spread misinformation by use of social media” during his release and is also “likely to cause unrest in the society.”
“His regular bail application has been dismissed by this court and the appeal by the division bench of the High Court,” the police had said. “Further, his parents are capable of making all necessary arrangements.”
Khalid was denied bail by Delhi High Court on October 18 saying that the allegations against him were prima facie true and so Section 43D(5) of the Unlawful Activities (Prevention) Act prevents granting him bail.
