RJD Legislator Osama Shahab Denied Anticipatory Bail in Siwan Land Dispute

The court cites the seriousness of allegations; the defence claims political conspiracy as legal pressure grows on the young legislator

SIWAN — Legal troubles have increased for Osama Shahab, Rashtriya Janata Dal (RJD) MLA from Raghunathpur Assembly constituency, after a local court in Siwan rejected his anticipatory bail plea in connection with a land dispute case.

The order was passed by the court of Principal District and Sessions Judge Motish Kumar Singh on Tuesday, following a detailed hearing in which both the defence and prosecution presented their arguments.

During the hearing, counsel for the MLA argued that the case had been filed with political intent. Advocate Navendu Shekhar Deepak, appearing for the defence, told the court, “My client has been falsely implicated due to a political conspiracy and has no direct link with the dispute.” He urged the court to grant relief from arrest.

However, the prosecution strongly opposed the plea. Public Prosecutor Parmel Kumar, also known as ‘Gop Babu’, argued that the case was serious in nature and involved several accused. “Granting anticipatory bail at this stage may affect the ongoing investigation,” he submitted.

After hearing both sides, the court rejected the anticipatory bail application, observing the seriousness of the allegations and the need for a proper investigation.

The case stems from a First Information Report (FIR) registered on 15 April at the Mahadeva police station in Siwan. In the complaint, Shahab and three others have been named as accused, while 30 to 35 unidentified persons have also been mentioned.

The complaint was filed by Dr Vinay Kumar and his wife, Dr Sudha Singh, residents originally from Gopalganj district. The couple is currently living in Gorakhpur. They have alleged involvement of the accused in a land-related dispute, though detailed allegations are part of the ongoing investigation.

The court’s decision means that Shahab may face further legal action as the investigation continues. Legal experts say that denial of anticipatory bail in such cases often indicates that the court considers the matter serious enough to require custodial interrogation.

A lawyer familiar with the case said, “When anticipatory bail is rejected, it generally means the court believes that the investigation should proceed without restrictions at this stage.”

Osama Shahab, 32, is a first-time legislator.

He is the son of Mohammad Shahabuddin, a well-known political figure from Bihar. His entry into active politics has drawn attention in the state, particularly in the Siwan region.

So far, there has been no official statement from Shahab following the court’s order. Sources close to the MLA said that his legal team is considering further options.

The investigation in the case is ongoing, and police officials have indicated that they will proceed based on the evidence collected during the inquiry.

The development has added a new dimension to the political and legal situation in the region, with attention now focused on the next steps in the case.
